Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Ara service ("Ara Service" or "Service") provided by Nexus Co., Ltd. ("Nexus," "Company," "we," "us," or "our"). Ara uses OpenAI's API to deliver artificial intelligence-powered services. By accessing or using Ara, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Ara Service.

1. Description of the Ara Service

Ara is a blockchain-integrated AI service provided by Nexus that delivers AI-powered interactions to users through the CROSS platform. Ara leverages OpenAI's API to provide intelligent responses and interactions. The Ara Service is designed to answer questions specifically limited to the use and operation of the CROSS platform.

CROSS platform is a decentralized game content platform operated by Nexus, supporting blockchain-based interactions such as NFT minting, tokenized in-game economies, and game-integrated wallet services. It connects game developers and users via interoperable infrastructure and provides tools for blockchain-enabled game experiences.

2. User Access

Ara does not require the creation of a separate End User Account. Instead, Ara is accessible to users who are already using the CROSS platform. If you access Ara through CROSS platform, you are considered an End User for the purposes of these Terms.

You are solely responsible for all activity occurring in connection with your use of Ara, including any actions taken using your CROSS platform credentials or associated blockchain wallet. You must:

  • Keep your credentials and wallet secure
  • Ensure your use complies with these Terms and applicable laws
  • Obtain any necessary consents to allow Ara and Nexus to process your data for the purpose of delivering the Services

3. Use of OpenAI API Services

Ara relies on OpenAI's API, and your use of Ara is subject to OpenAI's Services Agreement. Key terms include:

  • You acknowledge that OpenAI and its licensors retain all ownership rights in the OpenAI services
  • You may not use Ara or its outputs to violate OpenAI's usage policies or applicable law
  • End Users must not attempt to reverse engineer, scrape, or misuse OpenAI-generated outputs

You agree to allow OpenAI to process your prompts and content in accordance with its privacy and data use policies.

4. Eligibility and Restrictions

To use the Ara Service, you must:

  • Be at least the age of majority in your jurisdiction
  • Not be located in a country subject to sanctions
  • Use the service only for lawful and non-commercial personal or internal business purposes

5. Data Privacy

Nexus does not store or access your private key or wallet credentials. Ara does not retain personal data beyond what is necessary to provide the Service. By using Ara, you consent to the transfer and processing of your data through OpenAI's API services, which may be hosted outside your jurisdiction.

6. Intellectual Property

All content and outputs generated by Ara may be subject to intellectual property rights. Nexus retains ownership of the Ara platform, and OpenAI retains rights over the underlying model and services.

7. Limitations and Disclaimers

The Ara Service is provided "as is" and without warranty. Nexus does not guarantee the accuracy, completeness, or fitness of any output. AI-generated responses may be incorrect, offensive, or biased. You are responsible for independently verifying any critical information.

Nexus disclaims any liability for:

  • Any loss resulting from reliance on AI-generated outputs
  • Data loss or service unavailability
  • Violations of OpenAI’s terms arising from your use

8. Modification and Termination

Nexus may modify these Terms or suspend Ara Service at any time. Continued use after changes constitutes acceptance. We may terminate your access if you violate these Terms or applicable law.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Republic of Korea. All disputes shall be resolved exclusively in the Seoul Central District Court.
